These terms apply when you use whimsylotus.com or place an order with Bouas Ventures LLC, doing business as WhimsyLotus, a handmade shop in O'Fallon, Missouri ("we," "us"). By using the site or ordering, you agree to them. Please also read our Return & Exchange Policy and Privacy Policy, which are part of these terms.

Orders and pricing

• Prices are in US dollars and don't include shipping or applicable sales tax, which are shown at checkout.

• Your order is accepted when we send the order confirmation email. We may decline or cancel an order, with a full refund, if an item is unavailable, a price or description was listed in error, or we suspect fraud.

• Discount codes have no cash value, may be limited to one use per customer, and can be changed or ended at any time.

Personalization and proofs

• Please double-check spelling, names, dates and other details before you submit. We make your item exactly as approved.

• For personalized and custom items we send a free digital proof. Production starts only after you approve it, so a prompt reply keeps your order on schedule.

• Once you approve a proof, we can't be responsible for errors in the approved text or design.

Content you provide

When you send us names, text, photos, handwriting or artwork to use on your item, you confirm you have the right to use it and you let us use it to make your order and to prepare your proof. We may decline requests that include trademarked characters or logos, copyrighted artwork you don't own, or content we consider offensive.

Handmade products

Every piece is made to order from natural materials. Wood grain, knots and stain color vary from piece to piece, and colors may look slightly different on your screen. These natural variations are not defects. Some items, such as ornaments and small tags, contain small parts and are decorative, not toys; keep them away from young children.

Production and shipping

• Most orders are made and shipped within 2–5 business days after proof approval (or after purchase for items that don't need a proof). This is an estimate, not a guarantee. If we can't ship within the time we promised, we'll let you know and you can cancel for a full refund.

• We currently ship within the United States via USPS. Delivery times after shipping are set by the carrier.

• Holiday "order by" dates assume standard processing and shipping and are our best estimate.

• Please make sure your shipping address is correct. See our Return & Exchange Policy for what happens with incorrect addresses, lost packages and damaged items.

Cancellations, returns and exchanges

You can cancel free of charge within 24 hours of ordering. Cancellations, returns and exchanges, including our 15% cancellation and restocking fees, are covered in our Return & Exchange Policy.

Payments

Payments are processed by Squarespace Payments and the payment method you choose. If you use a buy-now-pay-later option such as Klarna, that provider's terms also apply.

Customer accounts

If you create an account, keep your login details private. You're responsible for activity in your account, and you can ask us to delete it at any time.

Reviews

If you leave a review, you agree we may display it on our site and in our marketing. Please keep reviews honest and respectful; we may remove reviews that are abusive, off-topic or contain personal information.

Our designs and site content

Our designs, photos, product descriptions and other site content belong to Bouas Ventures LLC (WhimsyLotus). You may share links to our products, but please don't copy, resell or reproduce our designs or photos without written permission.

Using our site

Please don't misuse the site, for example by trying to disrupt it, access other people's information, or use it for anything unlawful.

Disclaimers

We work hard to describe our products accurately, but the site and our products are provided "as is" to the fullest extent permitted by law. Nothing in these terms limits any rights you have under consumer protection laws that can't be waived.

Limitation of liability

To the fullest extent permitted by law, Bouas Ventures LLC is not liable for indirect, incidental or consequential damages, and our total liability for any claim related to an order is limited to the amount you paid for that order.

Governing law

These terms are governed by the laws of the State of Missouri. Any dispute will be handled in the state or federal courts located in St. Charles County, Missouri, unless the law where you live requires otherwise.

Changes to these terms

We may update these terms from time to time. The version posted when you place an order applies to that order.
